These terms of use govern your use of our platform, located at https://trustestate.co.uk, and any associated platform services or features (collectively referred to as the “Trustestate platform"). By using the Trustestate platform, you agree to comply with these terms and conditions. If you do not agree with these terms, please close your Trustestate platform account by contacting support@trustestate.co.uk.

1. Acceptance of Terms

1.1. By accessing or using the Trustestate Platform, you represent that you are aged 18 or over and have the capacity to enter into a legally binding agreement.

1.2. You acknowledge and agree that these terms of use constitute a legally binding agreement between you and Trustestate ("Company") regarding your use of the Trustestate platform.

2. Intellectual Property

2.1. All content and materials available on the Trustestate platform, including but not limited to text, graphics, images, logos, trademarks, audio clips, videos, and software, are the property of the Company or its licensors and are protected by applicable intellectual property laws.

2.2. You may not use, reproduce, modify, distribute, or display any content from the Trustestate platform without prior written permission from the Company. Unauthorised use of any content may violate intellectual property laws and result in legal consequences.

3. User Conduct

You agree to use Trustestate’s platform for lawful purposes and You shall not engage in any activity that may:

  • Infringe upon the rights of others;
  • Be harmful, threatening, or abusive;
  • Violate any applicable laws or regulations;
  • Disrupt or interfere with the functioning of the Trustestate platform or hack into any systems;
  • Attempt to gain unauthorised access to Trustestate platform, the server on which any of the services or platform are stored or operate from, or any server, computer or database connected to the Trustestate platform;
  • Transmit or distribute any malicious software or harmful content;
  • Collect or store personal information of other users without their consent.

4. Our rights

4.1 The Company reserves the right, in its sole discretion, to determine whether a breach of these terms of use has occurred. In the event of a breach, we may take any action we deem appropriate.

4.2. If we have reason to suspect or receive evidence suggesting that you have violated these terms or failed to comply with them, we reserve the right to undertake any or all of the following actions:

  1. Immediate, temporary, or permanent suspension or revocation of your access to the Trustestate platform.
  2. Issuance of a warning to you regarding the breach.
  3. Initiation of legal proceedings against you to seek reimbursement of all costs incurred on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  4. Pursuit of further legal action against you.
  5. Disclosure of any relevant information to the appropriate authorities and/or law enforcement agencies as we deem necessary.
  6. Implementation of any other measures that we consider appropriate in the circumstances.

5. Limitation of Liability

You expressly understand and agree that the Company shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use of the Trustestate platform.

6. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any and all claims, liabilities, damages, costs, and expenses, including reasonable attorney's fees, arising out of or in connection with your use of the Trustestate platform or any violation of these terms of use.

7. Modifications to the Terms

The Company reserves the right to modify or update these terms of use at any time, without prior notice. It is your responsibility to review these terms periodically for any changes. Your continued use of the Trustestate platform after any modifications will constitute your acknowledgment and acceptance.

8. Governing Law and Jurisdiction

8.1 This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

8.2 Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of England.
